1. Acceptance of Terms

By accessing or using the Midlife Power Index website and assessment (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and LUMAA Media LLC ("LUMAA", "we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.

2. About the Service

The Midlife Power Index™ ("MPI") is a research assessment designed to measure and map the real lived experience of women navigating midlife across multiple dimensions including career, financial security, health, relationships, purpose, and freedom.

The MPI is operated by LUMAA Media LLC as part of the LUMAA movement — Living Unapologetically in Midlife and Aging. LUMAA is a media company that commissions and publishes original research to amplify the voices of women in midlife. The Service is provided for research, educational, and personal reflection purposes only.

3. Eligibility

The Service is intended for adults aged 18 and over. By using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you are not permitted to use the Service.

The Service is designed for women navigating midlife, broadly defined as women aged 35–75. However, we do not restrict access by age, and all adults are welcome to participate.

4. Research and Educational Purpose — Important Disclaimer

The Midlife Power Index is a research study, not a medical, psychological, clinical, or financial assessment. Your index score and dimension results are provided for personal reflection and research purposes only.

Nothing in the Service constitutes:

• Medical advice, diagnosis, or treatment
• Psychological or mental health assessment or counselling
• Financial, investment, or legal advice
• A substitute for consultation with a qualified professional

If you have concerns about your health, mental wellbeing, finances, or any other personal matter, please consult a qualified professional. The MPI score is a research instrument, not a clinical tool.

5. Your Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Submit false, misleading, or fraudulent responses
• Attempt to reverse-engineer, copy, scrape, or reproduce the assessment questions, scoring methodology, or any part of the Service
• Use automated tools, bots, or scripts to access or interact with the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorised access to any part of the Service or its related systems

We reserve the right to suspend or terminate your access to the Service at any time if we believe you have violated these Terms.

6. Intellectual Property

All content on the Midlife Power Index website and within the assessment — including but not limited to the assessment questions, scoring framework, dimension methodology, copy, design, graphics, logos, and the LUMAA brand — is the exclusive intellectual property of LUMAA Media LLC and is protected by applicable copyright, trademark, and intellectual property laws.

You may share your personal index score and results for personal, non-commercial purposes (e.g., on social media) provided you credit the Midlife Power Index and include a link to the site. Any other reproduction, distribution, or commercial use of our content without prior written permission is strictly prohibited.

7. Research Data and Your Consent

By completing the assessment, you consent to your anonymised responses being used as part of the Midlife Power Index research dataset. Your responses will be fully anonymised before any analysis, publication, or sharing.

We may publish aggregated, anonymised findings from the research in reports, articles, media, and academic publications. No individual's responses will ever be published or shared in a form that could identify them.

8. Email and Communications

If you provide your email address, you consent to receiving your personalised index score and, if you opt in, future research updates and communications from the Midlife Power Index and LUMAA Media LLC.

You may unsubscribe from marketing communications at any time by clicking the unsubscribe link in any email or by contacting us at hello@themidlifepowerindex.com. Transactional emails (such as your results delivery) are not subject to opt-out.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any research findings, scores, or content provided through the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law, LUMAA Media LLC and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Reliance on your index score or results for any personal, medical, financial, or professional decision
• Any errors, inaccuracies, or omissions in the research findings
• Any interruption or unavailability of the Service

Our total liability to you for any claim arising out of or related to the Service shall not exceed the amount you paid to access the Service (which, as the Service is currently free, is zero).

11. Indemnification

You agree to indemnify, defend, and hold harmless LUMAA Media LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Third-Party Links and Services

The Service may contain links to third-party websites or services, including Typeform (our survey platform). These links are provided for your convenience only. We have no control over the content or practices of third-party sites and accept no responsibility for them. Your use of any third-party site is governed by that site's own terms and privacy policy.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read our Privacy Policy carefully before participating in the assessment.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York.

If you are located outside the United States, you may also have rights under the laws of your local jurisdiction.
